1. Overview

Welcome to Rivy. These Terms of Service ("Terms") govern your use of the Rivy application and related services. By downloading, installing, accessing, or using Rivy, you agree to be bound by these Terms. If you do not agree, do not use Rivy.

Rivy is a user-generated content ("UGC") and social interaction platform that enables users to create, share, and engage with content including images, videos, posts, topics, comments, wallpapers, and chat messages.

4. Account, Access, and Security

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account
• Do not share your account, attempt to impersonate others, or misrepresent your identity
• Notify us immediately if you suspect any unauthorized access or security breach
• You are solely responsible for any content posted or actions taken through your account
• We reserve the right to refuse service, terminate accounts, or cancel access at our discretion

5. Acceptable Use and Zero-Tolerance Policy

We enforce a strict zero-tolerance policy for offensive content and misuse. You agree not to use rivy to:

5.1 Prohibited Content Categories

• Sexual and Pornographic Content: Share explicit sexual content, nudity intended for arousal, sexual exploitation, or solicitation
• Disturbing or Graphic Content: Share gore, extreme violence, or content designed to cause discomfort or shock
• Gambling: Promote or facilitate gambling activities where prohibited, including betting tips and illegal gambling
• Drugs and Illegal Substances: Promote the sale or use of illegal drugs or controlled substances
• Political Propaganda: Engage in organized political campaigning or content aiming to influence political opinions or elections
• Hate, Harassment, and Discrimination: Attack, insult, or discriminate based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, age, disability, or any protected characteristic
• Illegal Activities: Incite or promote illegal acts (e.g., weapons sales, identity theft, fraud)
• Spam, Scams, and Malicious Behavior: Conduct deceptive schemes, phishing, unsolicited promotions, or distribute malware
• Privacy Violations: Share others' personal data without consent; doxxing or stalking
• Copyright/IP Infringement: Upload content you do not own or lack rights to use
• Technical Misuse: Reverse engineer, interfere with, or bypass security measures

5.2 Cosplay Community Standards

As a cosplay-focused platform, we maintain specific standards:

• Content must be appropriate for a general audience (18+)
• Cosplay content should respect intellectual property rights
• Give credit to original creators when appropriate
• Respect the work and effort of fellow cosplayers
• Do not steal or claim others' cosplay work as your own

6. UGC Rules, Moderation, and Enforcement

User-generated content is at the core of rivy. To protect the community:

6.1 Content Moderation

• We may remove violating content without notice
• We may issue warnings, temporary suspensions, or permanent bans for policy violations or misuse
• All content is subject to review by automated systems and human moderators
• We reserve the right to remove any content that violates these Terms or community standards

6.2 User Tools

• Block: Users can block other users to prevent further contact
• Report: Users can report content, posts, comments, or other users for review
• Blacklist: Manage your blocked users list in Privacy & Safety settings

6.3 Enforcement Actions

• First violation: Warning and content removal
• Repeated violations: Temporary suspension (1-30 days)
• Severe violations: Permanent account termination
• We may cooperate with law enforcement where required by law

7. Content Ownership and License

7.1 Your Content Rights

• You retain your rights to all content you submit to rivy
• You are responsible for ensuring you have the necessary rights to the content you post
• You represent and warrant that your content does not violate any laws or third-party rights

7.2 License to rivy

By submitting content to rivy, you grant us a worldwide, non-exclusive, royalty-free license to:

• Host, store, reproduce, and display your content within the service
• Distribute your content to other users as part of the normal operation of the service
• Create derivative works for the purposes of operating and improving rivy
• Use your content for promotional purposes with your consent

This license is subject to applicable laws and your privacy settings. The license terminates when you delete your content, except where retention is required by law or where content has been shared by other users.

7.3 Copyright Protection

We respect intellectual property rights. If you believe your copyright has been infringed, please contact us at support@rivyapp.com with:

• Description of the copyrighted work
• Location of the infringing content in our app
• Your contact information
• A statement of good faith belief that use is unauthorized
• A statement of accuracy and authority to act on behalf of the copyright owner

8. Third-Party Services and Links

rivy may integrate or link to third-party services, including:

• App Store: For in-app purchases
• External Links: Links to external websites or resources

We are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their respective terms and privacy policies.

9. Service Modifications and Availability

We reserve the right to:

• Modify, suspend, or discontinue any features of rivy at any time
• Perform maintenance, updates, or improvements with or without notice
• Change pricing, features, or availability of in-app purchases
• Update these Terms from time to time

We will make reasonable efforts to notify users of significant changes, but we are not obligated to do so for minor updates.

10. Account Termination

10.1 Termination by You

You may stop using rivy at any time by:

• Uninstalling the application from your device
• Requesting account deletion through the app settings or by contacting support

10.2 Termination by Us

We may suspend or terminate your access to rivy at any time for:

• Violations of these Terms of Service
• Suspected fraud or illegal activity
• Legal compliance requirements
• Extended periods of inactivity
• Any other reason at our sole discretion

10.3 Effects of Termination

• Your right to access and use rivy will immediately cease
• Your account data may be deleted
• Unused virtual items (coins) will be forfeited without refund
• Certain provisions of these Terms will survive termination

12. Disclaimers and Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• rivy is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• We do not guarantee uninterrupted, secure, or error-free service
• We do not warrant that the service will meet your requirements or expectations
• We are not responsible for user-generated content and do not endorse any opinions expressed by users
• We do not guarantee the accuracy, completeness, or usefulness of any content
• Use of the service is at your own risk

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• rivy and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for loss of profits, revenue, data, use, goodwill, or other intangible losses
• These limitations apply whether based on warranty, contract, tort (including negligence), or any other legal theory
• This applies even if we have been advised of the possibility of such damages
• Some jurisdictions do not allow limitation of liability for certain types of damages, so some of these limitations may not apply to you

14. Indemnification

You agree to indemnify, defend, and hold harmless rivy and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use or misuse of the service
• Your content and any content you post or share
• Your violation of these Terms of Service
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights, including intellectual property rights or privacy rights

15. Governing Law and Disputes

These Terms are governed by applicable laws in your jurisdiction and/or the jurisdiction of Rivy's principal place of business, subject to mandatory consumer protections.

15.1 Dispute Resolution

• For any disputes arising from these Terms or your use of rivy, you agree to first contact us at support@rivyapp.com to attempt informal resolution
• If informal resolution is unsuccessful, disputes will be resolved through the courts having appropriate jurisdiction
• Some jurisdictions may require arbitration or other alternative dispute resolution methods

15.2 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.

16. Additional Terms

16.1 Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and rivy regarding your use of the service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may freely assign these Terms.

16.5 Language

These Terms may be translated into other languages for convenience. In the event of any conflict, the English version shall prevail.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or for other legitimate reasons. When we make material changes, we will:

• Update the "Last Updated" date at the top of this document
• Notify you through in-app notifications or other appropriate means
• Require your acceptance for significant changes

Your continued use of rivy after changes take effect indicates your acceptance of the updated Terms. If you do not agree to the changes, you must stop using rivy.
